Competition Compliance Programmes: A Comparative Law & Economics Analysis

This project studies internal corporate structures that business may use to ensure compliance with competition law through a comparative legal and economic lens. The project involves both theoretical and empirical research. First, from theoretical point of view, we analyse the different approaches to competition compliance programmes adopted by antitrust agencies in various jurisdictions looking for any identifiable patterns or evolving attitudes. Besides recent trends, we investigate the causes and consequences of competition compliance policies and strategies that antitrust authorities and businesses employ with a view to conceptualise and appreciate their value from a normative perspective. Second, our empirical study samples a variety of businesses operating in Sweden (multinationals or local, big or small) to learn about how compliance is organized within the organisation and what policies might facilitate it. The study is designed to inform our assessment of compliance programmes and any policy recommendations we will make during our research. Overall, the project aims to explore the operation and effectiveness of competition compliance programmes and their interplay with competition policy and enforcement. The project is implemented by a team of three interdisciplinary legal scholars led by Anna Tzanaki (School of Law, University of Leeds) and supported by an international Board of Experts.
