Derivative Actions in Corporate Law

The project examines the statutory regime that permits the initiation of derivative actions by shareholders in the UK.
Specifically, it examines one element of the permission process that has to be followed by a shareholder to be able to pursue a derivative action and it explores the need for changes to the regime and the judicial approach to the derivative action procedure.
It also examines the derivative action as a form of shareholder remedy and including a consideration of the approaches taken in Europe in relation to this action.
