This paper builds on the author’s earlier work to undertake a comparative analysis of common law judicial approaches to disputes concerning photographic images of individuals in US and English law. It is concerned with understanding and analysing how courts in both jurisdictions manage the interface between privacy interests, rooted in spiritual-dignitary concerns, and publicity or exploitation-based interests rooted in commercial concerns. In particular, it considers cases that simultaneously engage both interests, even though they are often viewed as distinct and conflicting. The paper will first outline the phenomena of commodification which facilitates the market exchange of images, a process that both shapes common law and that the common law, in turn, shapes. It then considers the US image appropriation tort, the last of Prosser’s four privacy torts. It draws comparisons with comparable English laws, including confidence, misuse of private information and passing off.

About the speaker

Rebecca Moosavian recently joined the School of Law to teach media and intellectual property law. She has published in the areas of privacy and the Iraq war, and have presented my research nationally and internationally.

In 2002, after qualifying as a solicitor with North East-based ‘legal aid’ firm Ben Hoare Bell, she joined Northumbria University law school where she taught jurisprudence, IP, and undertook course leadership and LLM Dissertation Director roles. In 2009 she successfully completed an M(Phil).

She has co-convened an SLS-funded conference, ‘Iraq: Legal-Political Legacies’ and worked on a funded project for the Equality and Human Rights Commission (EHRC), headed by Prof Rhona Smith. She is also co-convenor for the jurisprudence stream of the Society of Legal Scholars.
