Horizontal network commercial relationships in logistics – a role for contract law

The Centre for Business Law and Practice is pleased to welcome Marta Kolacz, PhD candidate at the Erasmus School of Law, Erasmus University Rotterdam, to present her work on Wednesday 23 May.

This presentation will show the horizontal network phenomenon in logistics and survey the English contract law in relation to it.

The topic of the seminar is a part of a PhD research project concerning cooperative logistics, particularly the practice of cargo consolidation that is organized by shippers (producing and distributing companies) before engagement of a carrier or logistics provider.

The presentation will show the horizontal network phenomenon in logistics and survey the English contract law in relation to it. The suites of the existing regulation will be examined looking for the room for the self-regulation of partners to cooperation.

Precisely, the issues discussed will consider:

  • A new role of manufacturing and distributing enterprises cooperating for joint transportation of goods,

  • Problems presented by horizontal networks,

  • Problems presented by contract law related to multiparty arrangements,

  • Boundaries set by the existing state regulation for the development of business self-regulation in the logistics context.

About the speaker

Marta Kolacz is a PhD candidate at the Erasmus School of Law, Erasmus University Rotterdam, having previously studied at the University of Gdansk, Poland, and the University of Ljubljana, Slovenia. Marta’s PhD thesis is titled ‘Cargo bundling: legal solutions for the collaboration aiming at smart bundling of goods flows of different companies.’

Marta was a recipient of an Erasmus Flagship Initiative grant in 2017 to organise the first Erasmus Early-Career Scholars Conference and was granted funding from Vereniging Erasmus Trustfonds to undertake a research project on the B2B collaborative economy. She has presented her work at the University of Helsinki, European University Institute Florence and at the International Conference on Business Case Research Conference in Hong Kong. In 2017 Marta was awarded a TalentFund grant and in 2016 secured a scholarship for the ATLAS summer course at Bucerius Law School, Hamburg Germany, as part of the ATLAS Agora Program. Since 2015 she has acted as Correspondent for the Institut du droit international des Transports et de la Logistique (IDIT), France.

Marta has joined the School of Law as Visiting Research Assistant between April and June 2018 under the Erasmus+ Staff Mobility for Teaching and Training scheme. During this time Marta has been working on her research project on the cooperative logistics under English law.
