Centre for Business Law and Practice annual lecture: Brexit, Ireland, Trade, Travel

The aim of this lecture is to explore the parameters of the emerging relationship between the UK and the EU through the lens of the Irish/UK borders: both land and sea.

Professor Imelda Maher is the Dean of Law and the inaugural Sutherland Full Professor of European Law at University College Dublin. She is interested in the relationship between law and governance especially in economic spheres. She has published extensively in competition law and also on EU governance and presents her work regularly at international conferences and workshops.

Professor Maher was general editor of Legal Studies (2012-2017) and is a member of the editorial boards of the European Law Journaland of the Irish Yearbook of International Law. Before returning to Ireland in 2006, she worked at the London School of Economics; the Research School of Social Sciences, Australian National University (where she was Director of the Centre for Competition and Consumer Policy); Birkbeck College, University of London; and Warwick University.

In 2011, Professor Maher was elected a Member of the Royal Irish Academy. She was the first Irish woman to become President of the Society of Legal Scholars of the UK and Ireland (2016-2017), the largest scholarly society of common lawyers in Europe and hosted the SLS Annual Conference in September 2017 at the Sutherland School.

About the lecture

The aim of this lecture is to explore the parameters of the emerging relationship between the UK and the EU through the lens of the Irish/UK borders: both land and sea.

The lecture will address two dimensions of that border.  First, the opaque, legally obscure and practically significant Common Travel Area between the two states will be examined and an assessment will be made as to how it may be affected by Brexit. Second, the issue of trade of goods will be explored in the context of regulatory alignment and the joint report of the UK and the EU on phase one of the Article 50 TFEU negotiations on the UK withdrawal from the Union. 

The third part of the lecture will then analyse the legal challenges for the second phase of A50 negotiations in squaring the relationship between the UK and Ireland after Brexit.
