Commodification of Image and the Privacy-Publicity Interface - Rebecca Moosavian

The Centre for Business Law and Practice is delighted to invite you Dr Rebecca Moosavian's seminar on Commodification of Image and the Privacy-Publicity Interface.

Please note this event date and venue have changed.

Abstract

This paper builds on the author’s earlier work to undertake a comparative analysis of common law judicial approaches to disputes concerning photographic images of individuals in US and English law. It is concerned with understanding and analysing how courts in both jurisdictions manage the interface between privacy interests, rooted in spiritual-dignitary concerns, and publicity or exploitation-based interests rooted in commercial concerns. In particular, it considers cases that simultaneously engage both interests, even though they are often viewed as distinct and conflicting. The paper will first outline the phenomena of commodification which facilitates the market exchange of images, a process that both shapes common law and that the common law, in turn, shapes. It then considers the US image appropriation tort, the last of Prosser’s four privacy torts. It draws comparisons with comparable English laws, including confidence, misuse of private information and passing off.
