Excessive Pricing in Pharmaceuticals - Pedro Caro de Sousa

The Centre for Business Law and Practice is delighted to welcome Prof. Pedro Caro de Sousa to present a seminar on excessive pricing in pharmaceuticals.

This paper will be relevant to anyone interested in competition law, markets and regulation, as well as any staff or students interested in business and commercial law. 

Abstract

A number of competition enforcement actions against excessive pricing have recently taken place in the pharmaceutical sector, despite competition authorities being reluctant to intervene directly against high prices and there being strong arguments for not intervening against exploitative excessive pricing conducts. While these excessive pricing cases seem to meet the criteria set out in the enforcement screens for bringing excessive pricing claims, the conditions that justify bringing such cases in the first place seem to be relatively common in the pharmaceutical sector. This raises questions regarding what is the best response to high prices in pharmaceuticals, particularly in light of the complex market and regulatory conditions that frame competition in this sector.

About the Speaker

Dr. Pedro Caro de Sousa is a Competition Expert with the OECD since 2015, where he has been working on a variety of competition-related topics. He is a qualified lawyer in Portugal and a barrister of England and Wales, having worked for Linklaters LLP between 2005 and 2014.

He obtained a DPhil from the University of Oxford in 2012, where he was a tutor in EU and competition law. Before joining the OECD, Pedro was a lecturer in Law at the University of Reading, and a tutor at King’s College, University of London. He was also a Visiting Scholar at the European University Institute and an Associate Research Fellow at New York University’s School of Law.
